You operate the agent, so your own privacy notice has to mention it. These paragraphs describe what our systems actually do. Copy the ones that apply, replace the parts in [brackets], and keep only the AI providers your account uses. This page is not legal advice; have your notice checked if you are unsure.
Details of our processing and the full list of subprocessors are in our privacy policy and the data processing agreement.
1. Web chat widget on your website
Chat assistant. This website offers an AI-assisted chat assistant operated on our behalf by Yachay Systems (KonzeptWeber LLC, 30 N Gould St Ste N, Sheridan WY 82801, USA) as our processor. When you use the chat, your messages, the time they were sent and a conversation identifier are processed. No login is required and no cookies are set. To generate replies, your messages are transmitted to language models of [OpenAI] (USA) and stored on servers in Germany so that we can read the conversation and handle your request. Legal basis: Art. 6(1)(b) GDPR (initiating a contract, arranging an appointment) and Art. 6(1)(f) GDPR (legitimate interest in handling inquiries). Transfers to the USA rely on the EU-US Data Privacy Framework and standard contractual clauses. We delete conversation data once it is no longer needed for your request, at the latest [period].
2. WhatsApp agent
WhatsApp. You can reach us on WhatsApp. Messages are handled by an AI-assisted assistant operated on our behalf by Yachay Systems (KonzeptWeber LLC, USA) as our processor. Communication runs over the WhatsApp Business API of Meta Platforms Ireland Ltd.; WhatsApp's own privacy policy applies in addition. Your messages are transmitted to language models of [OpenAI] (USA) to generate replies and are stored on servers in Germany so that we can read the conversation. Legal basis: Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR. You can contact us by phone or email instead at any time.
3. Physiotherapy practices: prescription photos and voice documentation
Add these two paragraphs if you use the prescription photo intake and the dictation feature.
Prescription photos. You can send us a photo of your medical prescription via WhatsApp. The photo is checked automatically to see whether it shows a legible prescription; for that check it is transmitted to [OpenAI] (USA). It is then stored on servers in Germany together with the prescription data we record (diagnosis or ICD-10 code, prescribed remedy, number and frequency of treatments, date of issue). We use this data solely for your treatment, scheduling and billing. Legal basis: Art. 9(2)(h) GDPR in conjunction with Section 22(1) no. 1(b) BDSG. You can present the prescription in person instead.
Treatment documentation. Your practitioner documents each treatment; this note may be dictated. The recording is used only to convert speech to text and is not stored. The transcript and the note structured from it, which your practitioner reviews and confirms, are stored on servers in Germany. Speech-to-text is provided by [OpenAI] (USA) as a subprocessor. We keep treatment records for the statutory period of ten years after the end of treatment (Section 630f(3) German Civil Code).

1. Chat-Widget auf Ihrer Website

Auf dieser Website steht ein KI-gestützter Chat-Assistent zur Verfügung, den Yachay Systems (KonzeptWeber LLC, 30 N Gould St Ste N, Sheridan WY 82801, USA) als unser Auftragsverarbeiter betreibt. Wenn Sie den Chat nutzen, werden Ihre Nachrichten, der Zeitpunkt und eine Gesprächskennung verarbeitet. Ein Login ist nicht nötig, Cookies werden nicht gesetzt. Zur Beantwortung werden Ihre Nachrichten an Sprachmodelle von [OpenAI] (USA) übermittelt und auf Servern in Deutschland gespeichert, damit wir den Gesprächsverlauf einsehen und Ihre Anfrage bearbeiten können. Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO (Vertragsanbahnung, Terminvereinbarung) und Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an der Bearbeitung von Anfragen). Die Übermittlung in die USA stützt sich auf das EU-US Data Privacy Framework und Standardvertragsklauseln. Wir löschen Gesprächsdaten, sobald sie für Ihre Anfrage nicht mehr erforderlich sind, spätestens [Frist].
2. WhatsApp-Agent
WhatsApp. Sie erreichen uns über WhatsApp. Nachrichten bearbeitet ein KI-gestützter Assistent, den Yachay Systems (KonzeptWeber LLC, USA) als unser Auftragsverarbeiter betreibt. Die Kommunikation läuft über die WhatsApp Business API von Meta Platforms Ireland Ltd.; zusätzlich gelten die Datenschutzbestimmungen von WhatsApp. Ihre Nachrichten werden zur Beantwortung an Sprachmodelle von [OpenAI] (USA) übermittelt und auf Servern in Deutschland gespeichert, damit wir den Gesprächsverlauf einsehen können. Rechtsgrundlage: Art. 6 Abs. 1 lit. b und lit. f DSGVO. Sie können uns jederzeit stattdessen telefonisch oder per E-Mail erreichen.
3. Physiotherapie-Praxen: Verordnungsfotos und Sprachdokumentation
Ergänzen Sie diese beiden Absätze, wenn Sie die Entgegennahme von Verordnungsfotos und die Diktatfunktion nutzen.
Verordnungsfotos. Sie können uns ein Foto Ihrer ärztlichen Verordnung per WhatsApp senden. Das Foto wird automatisch daraufhin geprüft, ob es eine lesbare Verordnung zeigt; dafür wird es an [OpenAI] (USA) übermittelt. Anschließend wird es zusammen mit den von uns erfassten Verordnungsdaten (Diagnose bzw. ICD-10-Code, verordnetes Heilmittel, Anzahl und Frequenz der Behandlungen, Ausstellungsdatum) auf Servern in Deutschland gespeichert. Diese Daten nutzen wir ausschließlich für Ihre Behandlung, die Terminplanung und die Abrechnung. Rechtsgrundlage: Art. 9 Abs. 2 lit. h DSGVO in Verbindung mit § 22 Abs. 1 Nr. 1 lit. b BDSG. Sie können die Verordnung stattdessen persönlich vorlegen.
Behandlungsdokumentation. Ihre Behandlerin oder Ihr Behandler dokumentiert jede Behandlung; diese Notiz kann diktiert werden. Die Sprachaufnahme wird nur zur Umwandlung in Text verarbeitet und nicht gespeichert. Gespeichert werden auf Servern in Deutschland das Transkript und die daraus strukturierte Notiz, die Ihre Behandlerin oder Ihr Behandler prüft und bestätigt. Die Umwandlung in Text übernimmt [OpenAI] (USA) als Unterauftragsverarbeiter. Behandlungsunterlagen bewahren wir für die gesetzliche Frist von zehn Jahren nach Abschluss der Behandlung auf (§ 630f Abs. 3 BGB).

UU.) como encargado del tratamiento. La comunicación se realiza a través de la API de WhatsApp Business de Meta Platforms Ireland Ltd.; se aplica además la política de privacidad de WhatsApp. Sus mensajes se transmiten a modelos de lenguaje de [OpenAI] (EE. UU.) para generar respuestas y se almacenan en servidores en Alemania para que podamos leer la conversación. Base legal: Art. 6.1.b y 6.1.f RGPD. Puede contactarnos en cualquier momento por teléfono o correo electrónico en su lugar.
3. Consultas de fisioterapia: fotos de prescripciones y documentación por voz
Añada estos dos párrafos si utiliza la recepción de fotos de prescripciones y la función de dictado.
Fotos de prescripciones. Puede enviarnos por WhatsApp una foto de su prescripción médica. La foto se comprueba automáticamente para ver si muestra una prescripción legible; para esa comprobación se transmite a [OpenAI] (EE. UU.). Después se almacena en servidores en Alemania junto con los datos de la prescripción que registramos (diagnóstico o código CIE-10, tratamiento prescrito, número y frecuencia de sesiones, fecha de emisión). Usamos estos datos únicamente para su tratamiento, la programación de citas y la facturación. Base legal: Art. 9.2.h RGPD. Puede presentar la prescripción en persona en su lugar.
Documentación del tratamiento. Su profesional documenta cada sesión; esta nota puede dictarse. La grabación se utiliza solo para convertir la voz en texto y no se almacena. Se almacenan en servidores en Alemania la transcripción y la nota estructurada a partir de ella, que su profesional revisa y confirma. La conversión de voz a texto la realiza [OpenAI] (EE. UU.) como subencargado. Conservamos los historiales de tratamiento durante el plazo legal aplicable de [plazo].
